Last week, Governor Maura Healey signed the Shield Act 2.0, "the strongest law in America", which strengthens protections for both the providers and the patients of reproductive and gender-affirming healthcare in the state of Massachusetts.

Governor Healey is the 73rd and current Governor of Massachusetts, who assumed office on January 5, 2023. More notably, Healey broke new ground as the first woman and the first openly LGBTQ+ person to hold the position of Governor in the state’s history.

The Shield Act, “An Act Expanding Productions and Gender-Affirming Care,” was initially passed in 2022. The legislation followed decades of legal efforts within the state of Massachusetts that aimed to protect the ability to receive abortion care and to provide it.

“The law will also prohibit Massachusetts state authorities or local authorities from cooperating with any out-of-state or federal investigation into health care services that are legally protected in the state of Massachusetts, including gender-affirming care.”

The new legislation, the “Shield Act 2.0,” will formally establish that abortions are to be provided in emergencies and due to medical need, as well as it will prevent the disclosure of sensitive information.

Additionally, the law will also direct the Department of Public Health to create a technical advisory group that should provide support to businesses in regards to implementing privacy protections for storing and managing electronic medical records related to reproductive and gender-affirming health care.

While signing the legislation, Governor Healey stated that the law is “the strongest law in America and it will protect reproductive health care, gender-affirming care, and those who provide it.”

In a press conference following the signing, she continued by saying, “In Massachusetts, you have freedom, you have a choice, you have the free will to make health care decisions for yourself and your family. I think that’s so fundamental.”

House Chair, Joint Committee on Public Health, Representative Marjorie Decker also included her support for the legislation stating that it is “a critical defense against the attacks that the federal government continues to make against women and the LGBTQ+ community.”

A number of LGBTQ+ and women’s health advocates were present in support of Governor Healy’s “Shield Act 2.0,” including Reproductive Equity Now, the ACLU of Massachusetts, and Health Imperatives.

While there have been assaults on reproductive rights and access to gender-affirming care on the federal level, Governor Healey makes it clear that the state of Massachusetts will continue to protect its residents and will continue to make provisions for safe, evidence-based, and uniform health care.

The implementation of the Shield Act 2.0 reinforces Massachusetts’s role as a national leader in safeguarding reproductive freedom and gender-affirming care. By strengthening legal protections, enhancing privacy measures, and refusing to cooperate with out-of-state prosecutions, the state sends a clear message: access to essential health care is a right, not a privilege.

In the face of growing national restrictions, Governor Healey’s legislation stands as both a shield and a statement—affirming that in Massachusetts, bodily autonomy, dignity, and equality will remain protected for all.
